Prices: General estimates can be provided over the phone. Final pricese are agreed upon before work begins. Prices to be charged shall be the prices in force at date of billing or invoicing.
Terms of Payment: All work is accepted on a C.O.D. basis unless other arrangements have been made in advance and have been listed on the Service Order. Weekly progress payments are required on jobs lasting more than one week. Overdue accounts will be subject to late penalty fees of 5% per twenty day billing period. The customer agrees to pay all costs and expenses incurred by Remo in connection with the collection of amounts owing to Remo including but not limited to legal fees and costs. Customer hereby waives any claim for adjustment in billing which is not made within 20 days of receipt of billing invoice.
Cancellations: Cancellation of any contracted service within 24 hours of job start will be assessed a 25% service fee. In case of bad weather, project will be scheduled for completion at earliest agreeable time for client and Remo.
Scheduling: In case of work delay due to whether, project will resume at earliest date agreeable between the Company and property owner.
Terms Regarding Materials: Remo does not warrant materials or appliances installed. Should materials or appliances be defective or time be lost due to defective materials or appliances, Remo shall have no liability.
Terms Regarding Scheduling: Normal business hours are Monday-Friday, 7:00a.m.-5:00 p.m.
Severability: Each term of the Terms of Business is severable from every other and shall survive the nullity or unenforceability of the other.
Modification: These Terms of Business can only be modified by an instrument in writing signed by an authorized representative of Remo.
Warranty: Remo warrants the workmanship of its technicians for one year from the completion of work. Remo will perform the work in a workmanlike manner, in accordance with the standard practices of the industry. Remo does not warrant roof patches or repairs, or paint jobs on surfaces that will have foot traffic, such as decks, stairs, or porches. This warranty is not transferable.
Liens: In consideration of Remo performing work for the customer, Remo shall have a lien on customer's real property listed on the front of this agreement and/or any personality found thereon until full payment for any due and outstanding accounts is received and may sell, lease, or otherwise dispense of property upon which such lien is granted in its absolute and unfettered discretion upon giving 30 days notice in writing to the customer of its intention to sell, lease, or otherwise dispose of the property. Such written notice is duly given to the customer if sent by prepaid certified mail to the customer's last known address. In disposing of the property referred to in the preceding paragraph, Remo shall not be required to obtain the best price available. The lien may be discharged by paying to Remo the amount claimed by the notice of disposition and all reasonable costs and expenses incurred by Remo as a result of the customer's failure to comply with the terms of this agreement.
Entire Agreement: These Terms of Business and the rest of the Estimate or Service Order signed by the customer, as well as any Change Orders or Rider Sheets and valid written modifications constitute the entire agreement between the customer and Remo, and no evidence of any oral agreement or representation whatsoever shall be admitted to vary, modify, waive, or add to any or all terms of this agreement.
